These Terms and Conditions of Sale govern all purchases made via the IdeelArt website (“we” or “us”), a platform operated by C. Thomas Associates Limited.
These terms apply solely to activities conducted on the IdeelArt website and do not cover any other activities or services carried out by C. Thomas Associates Limited outside of this website, including any agreements not completed directly through the site.
These terms apply to all buyers, including both private individuals ("Consumers") and professional buyers purchasing on behalf of a business ("Professional Buyers"). By using our site and making a purchase, all buyers agree to the same terms outlined herein, regardless of their status as a Consumer or Professional Buyer.
By purchasing artwork through our site, you agree to these terms. Please read them carefully.
IdeelArt operates as an intermediary, representing both living artists and collectors in the sale of artwork.
IdeelArt does not take ownership of the artworks sold through the platform. Instead, we act on behalf of the artist or collector, promoting and facilitating the sale, managing payment, and handling shipping arrangements.
Artworks represented by living artists or artist estates on IdeelArt are guaranteed to be original and authentic. We vet each artist through a rigorous onboarding process that includes a series of subjective and objective criteria to ensure the quality and authenticity of the artist's work.
Each artwork is individually curated before being offered for sale. Most artworks are delivered directly from the artist’s studio, providing further assurance of authenticity.
Upon purchase, artworks come with a secure Certificate of Authenticity signed by IdeelArt on behalf of the artist. This certificate is provided by our trusted partner, Tagsmart, and guarantees the authenticity and originality of the artwork. Tagsmart is a trusted partner that specializes in secure and verifiable certification for artwork authenticity.
All living artists represented on IdeelArt can accept commissions. If you are interested in commissioning an artwork from one of our artists, please use our Contact Form to let us know more about your project.
Please note that these Terms and Conditions of Sale do not apply to such sales. When commissioning an artwork, special terms and conditions apply, and you will be required to sign a Commission Agreement clarifying those special terms and conditions.
This Commission Agreement covers standard market practice terms for creation timelines, deliverables, and artist obligations.Notably, after having agreed your project and pricing, a non-refundable payment of 50% will be required before any work is started by the artist, and full payment should be received before the artwork is shipped. Commissioned artworks cannot be returned.
In addition to selling directly from artists, IdeelArt facilitates the sale of artworks consigned from collectors.
Vetting and Quality Assurance: Collectors who wish to consign artworks for sale must provide detailed documentation proving the authenticity and provenance of the artwork, including a Certificate of Authenticity (COA) from a recognized gallery or an expert knowledgeable about the artist. Additionally, high-definition photographs of the artwork are required. IdeelArt conducts a thorough review of all provided documents and verifies the seller’s identity. However, as we do not physically inspect the consigned artwork, we rely on the representations and proofs submitted by the seller regarding the authenticity and condition of the artwork.
Role as an Intermediary: Buyers are informed that IdeelArt does not physically possess the consigned artworks. Instead, the platform acts as an intermediary, ensuring the authenticity and provenance of the piece based on the seller’s submissions.
All prices are transparently displayed for each artwork sold on IdeelArt. The prices shown are inclusive of any taxes due by IdeelArt, including Value Added Tax (VAT) where applicable.
Please note that import duties or taxes that may be due when importing an artwork to the buyer’s country are not included in the price. Such duties are the sole responsibility of the buyer. We advise buyers to check with their local tax authorities to understand any potential import charges that may apply.
In many cases, these import taxes correspond to the VAT rate applied to the sale of artwork in the buyer's country. Additionally, please be aware that in most countries, there may be reduced VAT rates for the sale of artworks, which can lower the potential cost of import duties.
All payments are processed securely through a third-party payment provider. IdeelArt manages all cash flows, ensuring that payment is received from buyers before artworks are shipped, and that payment is only released to the seller (artist or collector) after the return period has expired.
Buyers pay IdeelArt directly, and IdeelArt distributes the appropriate funds to the seller after deducting commission and other agreed fees.
IdeelArt is responsible for organizing and insuring the shipping of all artworks. However, packaging and handing over the work to the shipper is the responsibility of the seller (artist or collector). The seller must adhere to IdeelArt’s packaging guidelines to maintain professional standards and protect the artwork during transit.
For all artworks, IdeelArt fully insures deliveries. If the artwork is damaged during transit, IdeelArt’s insurance will cover the claim. In rare instances where insurance does not cover the damage, liability will depend on whether the issue was caused by packaging, shipping, or other external factors.
In the case of returns, to qualify for a refund the artwork must be returned in its original condition and packaging, undamaged.
To protect both buyers and sellers, IdeelArt will never ask a seller to ship an artwork before receiving full payment from the buyer. Likewise, IdeelArt holds payments in trust until the expiration of the return period, ensuring that the buyer is satisfied with the artwork before transferring his payment to the seller.
In the rare event of a dispute between the buyer and the seller, IdeelArt will act as a facilitator to help both parties reach a resolution. While we do not act as a legal mediator, we will provide assistance in resolving issues amicably.
Ownership of the artwork remains with the artist or collector until full payment is received and the artwork is delivered. Upon delivery, ownership is transferred to the buyer, and all risks associated with the artwork transfer to the buyer as well.
IdeelArt is not responsible for the physical condition of the artwork or any defects beyond what is represented in the documentation provided by the seller. All representations regarding the artwork’s authenticity, quality, and condition are based on information provided by the seller.
While IdeelArt vets sellers and ensures proper documentation, the buyer assumes the risk of relying on the seller’s representations. IdeelArt’s liability is limited to its role as an intermediary, and we make no warranties beyond what is expressly stated in these terms.
These Terms and Conditions of Sale are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or any transaction conducted through IdeelArt will be subject to the exclusive jurisdiction of the courts of England and Wales.
